Waiver Of Liability 

Essence Studioz – Waiver of Liability for Guest Participants (Classes & Rehearsals)

By completing and signing this waiver, all participants (and/or their legal guardians if under 18) acknowledge and agree to the following terms and conditions. Electronic submission of this form constitutes a valid and binding signature.

This waiver applies to any individual participating in a class, rehearsal, or studio rental at Essence Studioz LLC who is not formally enrolled in our dance programs. Participation is contingent upon acceptance of this waiver.

Acknowledgment of Risk

I understand and acknowledge that participation in dance classes, rehearsals, and related physical activities involves inherent risks, including but not limited to slips, falls, muscle strains, sprains, fractures, injuries, illness, or even death. I represent that I am in good physical condition and have no health-related conditions that would preclude safe participation.

Release of Liability

In consideration of being permitted to participate in activities at Essence Studioz LLC, I hereby release, waive, and discharge Essence Studioz LLC, its owners, instructors, employees, contractors, and agents, as well as Paterson Center City Mall (collectively, the “Released Parties”), from any and all liability, claims, demands, actions, or causes of action of any kind, whether in law or equity, arising from participation in any activities at Essence Studioz LLC.

This release covers, but is not limited to, claims for personal injury, illness, death, property damage, or loss, whether caused by the negligence of the Released Parties or otherwise.

Indemnification

I further agree to indemnify, defend, and hold harmless the Released Parties against any and all claims, suits, costs, attorney’s fees, or actions brought by me, my family, my estate, or any third party in connection with participation in activities at Essence Studioz LLC.

Personal Property

I understand and agree that Essence Studioz LLC and Paterson Center City Mall are not responsible for lost, damaged, or stolen personal property, including but not limited to items belonging to myself, fellow participants, or outside vendors.

Insurance & Medical Responsibility

I acknowledge that it is my responsibility to obtain and maintain adequate medical and/or liability insurance to cover any bodily injury, illness, or property damage that may occur while participating. I understand that Essence Studioz LLC does not provide accident or health insurance for participants. I assume full financial responsibility for any medical expenses resulting from my participation.

Severability

I agree that this waiver is intended to be as broad and inclusive as permitted under the laws of the State of New Jersey. If any portion is held invalid, the remainder shall remain in full force and effect.

Electronic Signature Agreement

By signing below, whether handwritten or electronic, I agree that my signature is valid, binding, and enforceable under the E-SIGN Act and UETA.
